Deposit Refund Policy (Auction Entry Guarantee)

Mobasher Online Auctions platform operates neutrally between customers wishing to purchase via the platform and various entities (government agencies, companies, institutions, individuals) who use the platform to display their products, whether real estate, vehicles, equipment, or any asset intended for sale. The sale method on the Mobasher platform is conducted through timed electronic auctions, live-streamed auctions, or sealed bids. Mobasher Auctions is considered a technical service provider for the aforementioned categories.

  1. Terms and Definitions:
    1. Deposit: The insurance paid to enter the auction, whether it is financial or a promissory note.
    2. Financial Deposit: The cash amount paid by the participant, considered part of the purchase price; referred to on the platform as "Insurance."
    3. Deposit as a Financial Instrument (Promissory Note): A document issued by the participant in favor of Mobasher Design Company via the "Nafith" platform (Ministry of Justice), whereby the participant commits to paying the value if they fail to pay the purchase price after winning the bid.
  2. Participation in auctions held via the Mobasher platform is based on the policies announced on the website in addition to the specific terms and conditions of each auction. Therefore, the user acknowledges that by bidding, they have reviewed and agreed to the platform's policies and the specific conditions announced in the auction's marketing brochure.
  3. The Mobasher platform is fully owned by Mobasher Company. When a customer participates in an auction, the entry deposit is collected through available payment methods (Sadaad/Edaat or Promissory Note via Nafith). It is deposited into the company's account and monitored in the participant's wallet.
  4. Participants must review the terms of each auction. Mobasher obligates the winning bidder who fails to pay to have the auction re-run at their personal expense, and they must pay the difference between their winning bid and the value achieved in the re-auction.
  5. Mobasher Company provides no guarantees and assumes no responsibility if the user fails to comply with the usage policy. It is not liable for risks, damages, or losses incurred by the buyer, seller, or any third party. Any damaged party should report this to: [email protected].
  6. Mobasher's actions regarding damages are limited to: (Documenting and archiving complaints to provide them to relevant authorities if required). Mobasher can provide information that helps restore rights between contractors without infringing on privacy.
  7. Refund Request:If a client does not win an auction, Mobasher returns the deposit upon request via the platform (Finance – My Wallet – Refund Request). The transfer or release of the promissory note takes (3) business days, provided all documentation (bank certificate matching platform info) is correct and the user is not linked to an active auction or pending financial transaction.
  8. Financial Deposit Refund Mechanism:Mobasher transfers deposits based on the customer info on the platform. Since payments are received via "Edaat" and linked to a specific bill, Mobasher considers all funds received through these bill numbers as belonging to the registered participant. Refunds are issued only to the registered participant's account; Mobasher will not transfer funds to third parties even if requested.
  9. Transfer of Deposits to the Selling Entity:
    1. If the auction is for government entities, cabinet-formed bodies, or major listed companies, Mobasher transfers the deposit to said entities without referring back to the client. Any disputes regarding defects in the item must be addressed directly with those entities.
    2. For private sector companies or individuals, Mobasher issues a bill for the remaining balance plus the marketer's commission. After payment and electronic title transfer via "Najiz" or other agreed methods, the transaction is finalized.
  10. Failure to Pay:
    1. In case of a Financial Deposit:If a winning bidder fails to pay for reasons other than a defect in the item, the Real Estate Brokerage Law regulations regarding deposit forfeiture will apply.
      • The deposit is considered part of the price and is not forfeited if the contract is canceled by the seller or broker without cause.
      • If the participant defaults, the deposit belongs to the property owner unless otherwise agreed.

      If the participant fails to pay and does not object within three business days, Mobasher reserves the right to transfer the full deposit to the owner.

    2. In case of a Promissory Note:If the winner fails to pay, Mobasher will demand the value of the promissory note as a debt. If ignored, the case will be referred for judicial execution, and the participant will bear legal fees.

Administrative Fees Refund Policy

All administrative fees are non-refundable, whether for creating a promissory note or issuing a payment bill, as stated in the wallet top-up section. Exceptions are made only for technical errors where the service was not provided despite payment.

Purchase Amount Refund Policy

Mobasher is a service provider. The participation in an auction is a contract between the buyer and seller. Mobasher is not a third party to the contract; it provides the technical platform only. Responsibility for the condition or defects of the item lies solely with the seller.

  1. When Inspection is Available:

    The participant must visit the auction site to inspect the item. Participation is an acknowledgment of purchasing the product in its "as-is" condition, and they have no right to retract.

  2. When Inspection is Not Available:

    Some entities prevent inspection for security or safety reasons. Sales are based on photos and data that may contain errors. Buying "as-is" without inspection means the participant accepts potential defects or data discrepancies and cannot claim against the seller later.

After the deal is awarded, an "Edaat" bill is issued. Mobasher transfers the purchase value to the seller to complete delivery. Mobasher's role is strictly as a technical service provider and is not liable for financial claims or refund requests between the two parties.
